1. Acceptance of Terms & Eligibility

By downloading, accessing, or using Divinari, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our website or applications.

Age Requirement: You must be at least 13 years old to create an account or use Divinari. If you are between 13 and the legal age of majority in your jurisdiction, you may only use Divinari under the supervision of a parent or legal guardian who agrees to these Terms.

2. Description of Service

Divinari provides a digital educational platform designed to connect faith, culture, and fluency through language acquisition, heritage preservation, cultural dictionary references, and scripture-aligned study modules.

Our services are accessible through the web application at divinari.app and cross-platform mobile applications for iOS and Android. We continuously refine our curriculum, features, and target language tracks (including Tagalog, Cebuano, Ilocano, and Spanish). We reserve the right to update, modify, or enhance services at any time.

3. Intellectual Property Rights

All contents, features, and functionality of Divinari—including but not limited to trade names, trademarks, the Divinari hummingbird emblem logo, visual design assets, lesson structures, audio recordings, dictionary databases, software code, and text—are the exclusive intellectual property of Divinari and protected by copyright, trademark, and international intellectual property laws.

Limited Educational License

Subject to your compliance with these Terms, Divinari grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, view, and use Divinari solely for your personal, non-commercial educational use.

Restrictions

You agree that you will not:

• Copy, distribute, modify, or create derivative works of any Divinari lesson content or proprietary dictionary entries.
• Reverse-engineer, decompile, or disassemble any part of the Divinari application or web software.
• Scrape, extract, or mine data from Divinari databases using automated bots or scripts.
• Use Divinari branding or hummingbird iconography without express prior written consent.

4. User Accounts & Authentication

To access certain features, you may register an account using Firebase Authentication (via Email/Password or supported third-party providers such as Google Sign-In).

• Credential Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• Accurate Information: You agree to provide accurate and current registration details.
• Account Termination: You may delete your account at any time via the More tab in the app settings, which triggers a complete wipe of your authentication details and local data.

5. Local Data Storage & User Responsibility

Divinari operates under a "Privacy by Design" architecture. Your learning progress, vocabulary mastery, flashcard review intervals, and streak data are stored locally in a Drift SQLite database directly on your device.

6. AI-Assisted Educational Content Disclaimer

Divinari incorporates automated exercise generation, contextual grammar hints, and adaptive practice loops powered by artificial intelligence and natural language processing.

While we take extensive measures to verify linguistic accuracy and cultural fidelity, AI-generated hints and exercise variations are provided for educational assistance on an "as-is" basis. Divinari does not guarantee that automated content will be completely free of minor typographical or grammatical errors in all dialectal variations.

7. Early Access, Subscriptions & Payments

Divinari offers free core features alongside optional early access programs, heritage packs, and future premium subscription tiers.

• Early Access & Waitlists: Joining a waitlist or early-access preview does not guarantee immediate access or specific future pricing guarantees.
• App Store Billing: In-app purchases and subscriptions are processed through the official Apple App Store or Google Play Store. Payments, renewals, cancellations, and refund requests are subject to the terms and billing policies of the respective app store platform.

8. Acceptable Use Policy & User Conduct

You agree to use Divinari only for lawful educational purposes. You agree not to:

1. Attempt to compromise the security, integrity, or network traffic of Divinari servers or Firebase infrastructure.
2. Transmit any virus, Trojan horse, worm, or malicious code through our platform.
3. Engage in automated bulk requests or attempt to overwhelm our API endpoints.
4. Impersonate any person, entity, or Divinari representative.

9. Account Suspension & Termination

We reserve the right to suspend or terminate your access to Divinari at our sole discretion, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or misused our platform. Upon termination, your right to use the platform ceases immediately.

10. Third-Party Services & External Links

Divinari integrates trusted third-party services, such as Google Firebase for authentication and optional privacy-first Google Analytics on our website. Our services may contain links to external sites or community resources. Divinari is not responsible for the content, privacy practices, or availability of third-party platforms.

11. Disclaimer of Warranties

DIVINARI AND ALL ASSOCIATED SERVICES, CONTENT, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. DIVINARI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability & Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIVINARI, ITS FOUNDERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

You agree to defend, indemnify, and hold harmless Divinari from and against any claims, liabilities, damages, judgments, or expenses arising from your violation of these Terms or misuse of the platform.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Divinari operates, without regard to its conflict of law principles.

In the event of any dispute or claim, you agree to first attempt an informal resolution by contacting Divinari support. If a resolution is not reached within 30 days, any legal proceedings shall be conducted individually and not as a plaintiff or class member in any class action.

14. Changes to Terms & Contact Information

We reserve the right to revise these Terms at any time. When updates are made, we will update the "Effective Date" at the top of this document. Continued use of Divinari following posted changes constitutes your acceptance of the updated Terms.
